When resolving a personal injury claim from a dog bite, location is everything. Specifically, the courts apply different standards based on whether the dog bite happens on or off the owner's property. This "enclosure" rule is extremely important, because it changes the difficulty of your lawyer's job in helping you resolve your personal injury claim.The first time a dog causes personal injury or property damage outside of their enclosure, the dog's owner will be liable for the damages the dog causes, plus the cost of the injured person's lawsuit. If the dog causes personal injury or property damage again, the dog's owner must pay twice the damages caused by the dog, and the dog may be put to sleep.This is generally known as the "one bite" rule. Proving this knowledge can be extremely difficult, as even a police report documenting a recent incident might not be enough to meet this standard for prior knowledge.The enclosure rule applies to the owner of a house or land, even if they do not own the dog. This means a landowner can be held responsible for the actions of the dog owned or kept by someone living on their property.
